Terms and Conditions

OC11-ACANA has to be used after noting the following terms and conditions.

OC11 Corp.(The Company）offers OC11-ACANA(The service) with this terms. The contract with all customers is based on this terms and conditions. The date and time in this document are based on U.S. Pacific Standard Time.

1. Services
Protecting service for the web servers which are connected to the Internet and promotion to be concerned.

2. Contract
The contract of this service is made at the time when the customer register the user information to the serivce.

3. Duration of contract
The minimum duration of contract of the toll service is three months and after that, renew the contract monthly(see Chapter 5). There is no duration of contract of free (no charge) plan and cancel automatically if there is no use for 3 months.

4. Payment
The price of this service are the ones the company decides, and the company do not refund by any reason. The way of payment is credit card payment basically, and the customer has to pay the fee with the way the company decides after informing the customer if the customer requests another payment method.

5. Renew and cancel
Contract is based on Chapter 3 of this document. Cancellation has to be requested by the customer by ten (10) days or more before the customer would like to cancel. The customer must pay total amount of unit duration even if it is the midway at duration of policy.

6. Prohibited matters
The following matters are prohibited.
* Act the company judges as illegal in the U.S. regulation.
* Act of violating others' copyright, properties, and privacies.
* Act that brings third party disadvantage by offering information on false
* Act that slanders third party
* Act of reselling this service without permission in our company.
* Act of declaring false to the company
* Act obstructively of security of our system like the following
* Ravage to our system and network
* Counterfeit act of TCP/IP packet header
* Act of access to internal data by no permission and logging in other contractors' accounts to the company
* All acts to try to use service without obstruction act use permission to other contractors

7. Stopping Service
The company asks for appropriate treatment by sending E-mail when contractors correspond to either of four items the following. Still, when our company judges that there is no intention changed to the contractor, our company will temporarily stop service to the contractor or cancel the contract. Moreover, it is assumed to a malignant contractor the one that service can be stopped without warning. The act of deleting all contractor's information and contractor's account and the act of prohibiting the data transmission to our server moreover are included with the stop of service. In this case, compensation for damages according to the service stop are assumed to be what the contractor cannot claim it to the company. Moreover, the company will not do the repayment of the charge after the contract is canceled while service is stopping.
・When the contractor does the prohibition act from which the contractor has been described to Chapter 6
・When the charge is not paid by the due date
・When the company judges that the contractor does the act that the large encumbrance extremely hangs to the service and considerable influences it for other contractors
・Additionally, when the company judgs that the contracter is not suitable to the serivce.

8. System Management
The service is assumed to be possible to be used basically for 24 hours a day and 365 days. However, when the operation of the system is stopped by an unavoidable reason like maintenance, construction or the natural disaster etc. of the trouble that originates in the data center, the trouble of the line that originates in the Telecom company, and the system, it is assumed the company to notify the contractor promptly. The system might be stopped without the notification in case of emergency,Moreover even if the contractor has any damage, the company do not have any responsibility at all. The company does not have the responsibility at all even if data in the server is damaged or disappears by the system failure.

9. Range of compensation for damages
The company does not owe liability at all even if damage of the contractor generated by the use of this service or by the management mistake. The company does not have any responsibility when the contractor disadvantage to the third party and the contractor must resolve with it's own responsibility. The stop time of service by any reason is considered while operating.

10. This Terms and Conditions Effect
This Terms and Conditions goes into force on the day when our company accepted the service application from the contractor.

11. Changing this terms and conditions
The company has the right to change this terms and conditions without notice to the contractor.

12. Competent court
When the lawsuit is caused between the contractor and the company for this terms and conditions, the court that has jurisdiction over our address is made an exclusive mutual agreement jurisdiction court.
